Terms of use for Greyshore Financial Trust website, mobile app, and banking services

1. Acceptance of Terms

By accessing or using the Greyshore Financial Trust website, mobile application, or any of our banking products and services (collectively, the "Services"), you agree to be bound by these Terms & Conditions ("Terms"). If you do not agree to these Terms, please do not use our Services.

These Terms apply to all users of our Services, including individuals who open accounts, apply for loans, make investments, or simply browse our website.

2. Eligibility

To use our Services, you must:

  • Be at least 18 years of age
  • Be a legal resident of the United Kingdom, United States, or European Union
  • Have the legal capacity to enter into binding contracts
  • Provide accurate and complete information during registration
  • Not be restricted from using banking services under applicable laws

3. Account Registration and Security

When you open an account with Greyshore Financial Trust, you agree to:

  • Provide true, accurate, current, and complete information about yourself
  • Maintain and promptly update your information to keep it accurate
  • Keep your login credentials (username, password, security questions) confidential
  • Notify us immediately of any unauthorized access to your account
  • Accept responsibility for all activities that occur under your account

We reserve the right to suspend or terminate accounts that violate these Terms or are used for fraudulent purposes.

4. Banking Products and Services

4.1 Deposit Accounts

Our deposit accounts (Checking, Savings, CDs, IRAs) are subject to specific account agreements, fee schedules, and interest rate disclosures provided at account opening. Interest rates are variable and may change without notice unless otherwise specified.

4.2 Lending Products

Personal loans, credit cards, and mortgages are subject to credit approval. Loan terms, including interest rates, fees, and repayment periods, will be disclosed in your loan agreement. Late payments may result in fees and negative credit reporting.

4.3 Investment Products

Investment accounts (ISAs, managed portfolios, SIPPs) involve risk, including the potential loss of principal. Past performance does not guarantee future results. Please review the Key Information Document (KID) and risk disclosures before investing.

5. Fees and Charges

We may charge fees for certain banking services, including but not limited to:

  • Monthly maintenance fees (waived for qualifying accounts)
  • Overdraft fees (if overdraft protection is used)
  • Wire transfer fees (domestic and international)
  • ATM fees for out-of-network withdrawals
  • Late payment fees for loans and credit cards
  • Early withdrawal penalties for CDs and fixed-term accounts

6. Electronic Communications

By using our Services, you consent to receive electronic communications from us, including:

  • Account statements and transaction notifications
  • Terms and conditions updates
  • Privacy policy changes
  • Marketing communications (you may opt out)
  • Security alerts and fraud notifications

You are responsible for maintaining an active email address and ensuring that our communications are not blocked by your spam filters.

7. Mobile App and Digital Services

Our mobile app is provided "as is" and "as available." We do not warrant that the app will be uninterrupted, error-free, or free from viruses. You agree to:

  • Keep your mobile device secure with passcode or biometric authentication
  • Install updates promptly to ensure security and functionality
  • Not use the app on rooted or jailbroken devices
  • Report any technical issues to our support team

8. Intellectual Property

All content on our website and app, including text, graphics, logos, icons, images, and software, is the property of Greyshore Financial Trust or our licensors and is protected by UK, US, and international copyright laws.

You may not reproduce, distribute, modify, create derivative works of, publicly display, or commercially exploit any content without our prior written consent.

9. Limitation of Liability

To the maximum extent permitted by law, Greyshore Financial Trust shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of our Services, including but not limited to:

  • Loss of profits, revenue, or business opportunities
  • Loss of data or damage to your computer systems
  • Unauthorized access to your accounts (unless caused by our negligence)
  • Investment losses resulting from market fluctuations

Our total liability to you shall not exceed the amount of fees you paid to us in the 12 months preceding the claim.

10. Indemnification

You agree to indemnify, defend, and hold harmless Greyshore Financial Trust, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising from:

  • Your violation of these Terms
  • Your use of our Services in violation of applicable laws
  • Your negligence or intentional misconduct
  • Unauthorized use of your account due to your failure to safeguard credentials

11. Third-Party Links and Services

Our Services may contain links to third-party websites or services that are not owned or controlled by us. We have no control over, and assume no responsibility for, the content, privacy policies, or practices of any third-party websites. You acknowledge and agree that we shall not be liable for any damages or losses caused by your use of third-party services.

12. Termination and Suspension

We may suspend or terminate your access to our Services at any time, with or without cause, including but not limited to:

  • Violation of these Terms
  • Fraudulent or illegal activity
  • Failure to pay fees or amounts owed
  • Providing false or misleading information
  • Inactivity for an extended period (as defined in account agreements)

Upon termination, your right to use our Services will immediately cease. Outstanding balances will remain due and payable.

13. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of England and Wales, without regard to its conflict of law provisions.

Any dispute arising from these Terms or your use of our Services shall first be attempted to be resolved through our internal complaint process. If unresolved, the dispute shall be submitted to binding arbitration in accordance with the rules of the London Court of International Arbitration (LCIA), or you may refer the matter to the Financial Ombudsman Service (FOS) if eligible.

14. Changes to These Terms

We reserve the right to modify these Terms at any time. Material changes will be notified to you by email or through a prominent notice on our website at least 30 days in advance. Your continued use of our Services after the effective date constitutes acceptance of the modified Terms.

15. Entire Agreement

These Terms, together with our Privacy Policy, Cookie Policy, and any specific product agreements you enter into, constitute the entire agreement between you and Greyshore Financial Trust regarding your use of our Services and supersede all prior agreements and understandings.
